Man Wrongly Arrested for 'Meth' that Was Doughnut Glaze Gets $37,500 Settlement

Last year, we witnessed the plight of a Florida man who was arrested and accused of methamphetamine possession when in actuality, the powder in his possession was merely excess doughnut glaze.

Sixty-four-year-old Daniel Rushing was charged with the crime after police found a white substance on the floorboard of his car when he was pulled over for speeding. According to the Orlando Sentinel, a roadside drug test was then administered by Orlando Police Department Corporal Shelby Riggs-Hopkins—who had never been trained to do so—which found the substance to be a narcotic.

After being booked on the drug charge and a firearm charge, Rushing spent ten hours in county jail, though a later drug test found that the incriminating substance was actually sugar from a glazed doughnut. Rushing was reportedly a breakfast pastry enthusiast who went to Krispy Kreme every other Wednesday.

Now, the Orlando Sentinel reports, sweet justice is being served in the form of a $37,500 payout to Rushing from the City of Orlando, in order to settle a lawsuit he filed after being falsely charged. Needless to say, being accused of meth possession has taken a pretty big toll on Rushing's life. "I haven't been able to work," he told the Orlando Sentinel. "People go online and see that you've been arrested."

He also told the Orlando Sentinel that while he still drives to Krispy Kreme to get doughnuts every other Wednesday, he no longer eats in his car. Can you really blame him? Sure, a biweekly doughnut run can be a guilty pleasure, but it shouldn't be punishable by jail time. Rushing is also reportedly suing the manufacturers of the drug testing kits in a pending lawsuit.
