In the early morning hours of December 28, 2012, police in San Antonio, TX, responded to a call after a 21-year-old Texas Tech student claimed that Jordan Hicks had raped her. According to the police report, Hicks and his teammate Case McCoy—whose names are redacted in the report—met the woman at a club on December 28, 2012; she had four drinks at the club and then invited the two men to the hotel where she was staying. At the hotel, she said, all three went to her hotel bar, and then she invited Hicks and McCoy back to her room. In the hotel room, the woman alleged, Hicks raped her. "I feel ashamed saying this, but I know [he] was in me," she told police. She also stated that McCoy "just stood there and watched." Police noted bruises on the woman's right knee and arm. The woman was transported to a hospital, where she was given a sexual assault exam.

Although both names are redacted in the report, identifying details included in the report—such as race, height, and weight—match up with those of Hicks and McCoy. In addition, Hicks and McCoy were both sent back home to Austin the day following the alleged incident and were suspended from playing in the Alamo Bowl game that weekend, though UT coach Mack Brown did not specify why they had been suspended.

On December 30, 2012, Hicks' attorney said all parties consented. Police conducted an investigation and declined to bring charges. In January 2013, the case was closed, and both players were reinstated to the UT team.

Hicks did not return Broadly's request for comment.
