In the early morning hours of September 6, 2010, an anonymous accuser alleged that Perrish Cox drugged, raped, and impregnated her at an apartment in Douglas County, CO.

According to statements collected over the course of the investigation, two other members of the Denver Broncos—Cox's team at the time—were present the night of the incident. According to the alleged victim's account to the police, she believes she was drugged while on a night out in Denver with Cox, one of his teammates, and two other females. After having approximately four drinks, the alleged victim felt "a little blurry" but recalls Cox's then-teammate Demaryius Thomas kissing her and rubbing her genitals at Cox's apartment. Then she blacked out. In the morning, she said, she woke up with her vaginal area sore and wet, but she had no memory of having sex. She went to the ER the next day and explained that she believed she had been drugged and raped. She was offered a rape kit but was told it would cost $500, and she said she could not afford it.

In interviews with police, Cox repeatedly denied that he ever had sex with the alleged victim. On October 28, 2010, the alleged victim found out she was ten-and-a-half weeks pregnant, placing the time of conception around the time of the alleged assault. On December 2, 2010, according to an affidavit for an arrest warrant, a prenatal DNA test confirmed that Cox was the father.

On December 9, 2010, Cox was arrested and charged with one count of sexual assault while the victim was physically helpless and one count of sexual assault while the victim was incapable of determining the nature of the conduct. He pleaded "not guilty."

Thomas later testified at Cox's trial that Cox carried the passed-out woman into a bedroom in his home and said, "I think she's ready," which Thomas understood to mean for sex. Thomas testified that he responded, "Nah. I don't think so." On March 2, 2012, Cox was found not guilty of two felony sexual assault charges.

Less than two weeks later, Cox signed a two-year contract with the 49ers. The team went on to play in the 2013 Super Bowl.
