A Convicted Sex Offender Is Suing the Victim’s Family for Beating Him Up

After assaulting an underage girl, the New Brunswick man says four people jumped him, leaving the man with a broken nose and a concussion.

A New Brunswick man is suing after the family and friends of a girl he was convicted of sexually assaulting confined and beat him. The beating incident occurred in New Brunswick in September 2015 and, according to the statement of claim, the man sustained a broken nose, a concussion, two black eyes, and multiple cuts as a result of the attack.

"He ran afoul of the law by being involved sexually with this young woman, and the court punished him. And it was not for other people [to punish him], be it her family or unknown vigilantes," the man's lawyer, David Lutz, said. "He is not necessarily suing the family members as family members of the young woman he was involved with. He is suing the people who beat him and confined him. If they happen to be the family members, so be it."

The man who was convicted of sexually assaulting the underage girl pleaded guilty, the Telegraph-Journal reports. His sentence was 90 days in jail—which he was allowed to serve on weekends.

The statement of claim says the man was initially punched in the face after being lured to a residence. When he tried to get away, he was attacked by two men and had a knife held to his throat while being threatened. After attempting an escape following this, his attackers "caught him and dragged him into a detached garage, wherein they confined and attacked [him] for 30 to 45 minutes."

According to the man's claim, one of his attackers had a blowtorch and threatened to take off a body part of his off with it. He was also hit in the head with a propane tank.

The car the man was driving, which belonged to his mother, was hit multiple times with an axe and sledgehammer. The lawsuit claims the attackers also stole the man's wallet, including $500.

According to the statement, "When the defendants finished their attacks on [the man] and allowed him to leave, they told [him] that they would kill him if he ever returned."

Four people were sentenced for the beating of the man, including the girl's mother and three men, the Telegraph-Journal reports. The mother was found guilty of assault causing bodily harm and mischief over $5,000, getting a sentence of three months in jail and 18 months of probation. One of the other attackers pleaded guilty to assault causing bodily harm, uttering threats, and mischief over $5,000, getting a sentence of one year in jail. Two others were found guilty of assault causing bodily harm and forcible confinement, each getting three months in jail and 18 months of probation.

Names of those involved are under a publication ban.

Both the man and his mother, whose car was smashed, are suing. The man claims he was left with "hemorrhaging inside his eyeballs," severe recurring headaches, anxiety, memory loss, and fear of being in public due to the attack. The claim also says that he has lost employment and education opportunities after the incident.

Currently, the defendants' lawyer has filed a notice of intent to defend.
